Argentinian genocide and its representations. Contribution of the judicial process in the construction of collective memory
Abstract
With the reopening of the trials for the crimes committed during the last dictatorship in Argentina (1976-1983), debates on the qualification of the facts as crimes against humanity or genocide and their different effects on society emerged. From the analysis of a representative group of rulings, this article analyzes the legal debates concerning the legal qualification, the ways in which the courts understand the socio-historical phenomenon under trial and the relationship between the two variables.
