THE ART OF GOVERNING THE EVIL AND THE GRAMMAR OF THE INHUMAN ON THE BRAZILIAN PENITENTIARY SYSTEM
Abstract
The article intends to raise the issue involving the relationship between the state and the incarcerated person, which includes violations of basic rights by the State. For this, the text uses the notion of the banality of evil of Hannah Arendt as reflective base to understand the attitude of the state in governmentality - from the concept of Michel Foucault - the Brazilian penitentiary system. The paper demonstrates that violations of fundamental rights are normalized to the State, as manager and guarantor of the system and enforcing rights, especially the fundamental, and make the direction of the performance of government tactics.
