Discurso del odio, protección de minorías y sociedad democrática
Abstract
La generalizada represión penal del discurso del odio se justifica en la necesidad de proteger los grupos minoritarios y tradicionalmente discriminados, pero ello se realiza a costa de limitar el ejercicio de la libertad de expresión, piedra basal en la que se sostiene el propio sistema democrático. Es imprescindible, por ello, hallar un equilibrio entre ambos aspectos en aras a alcanzar una limitación proporcionada de la libre expresión.
