Extranjeros en prisión. El papel de la expulsión
Abstract
En nuestro país, la persona extranjera se enfrenta a lo largo del proceso penal y penitenciario con una legislación claramente marcada por la política migratoria y el uso que esta hace de la expulsión. Durante el proceso penal el juez puede renunciar al “ius puniendi” archivando el proceso penal a cambio de la expulsión o determinar en sentencia la sustitución total o parcial de la pena impuesta por expulsión. Cuando la persona extranjera entra en prisión suelen encontrarse con una mayor incertidumbre sobre su situación en relación a los presos nacionales, prevaleciendo su situación de extranjero frente a la de preso. Una vez finalizada la condena, el preso extranjero ha de volver a enfrentarse a la posibilidad de ser expulsado conforme a la normativa de extranjería.
