Abstract

Family care is a basic need for children, from which derives the existence for them of a right to family life. This right should determine the structure and organization of the minor’s protection system, both nationally and internationally, especially in relation to family of origin aids, adoptability of children and foster care in extended family or others. However, the protection of the right to family life, with all its implications, currently suffers from significant shortcomings and serious contradictions, both domestic and international, on which reflection is necessary.
