Abstract

This I articulate it aims to examine the current situation in Spain concerning Non-E.U.Member States citizens and their rights to health care recognised by the Spanish Constitution. With specific reference to the health care rights of Non-E.U.citizens who are not in possession of work permits or recipients or beneficiaries of Public Health System benefits, it defines the nature, the scope and content of these rights to health care based on the applicable guidelines pertaining to alien status, Public Health System regulations, specific health legislation and the law of the Constitutional Court in matters relating to the interpretation of the Constitution. It also aims to make the link between the rights to health care benefits with basic rights recognised by the Constitution, particularly with regard to the need to provide consent prior to surgical procedures for Non-E.U. minors.
