Offenses against the segurity and the health at work

Abstract

The right to work that admitted the art. 35 of Spanish Constitution in 1.978, in can´t understanding without recognize also what his exercise must to do under ones particulars conditions, and it must guarantee in first place, the worker´s life and in second place his health or physical integrity. There´s a great regulation heading for prevent the labour dangers that the worker can confornt and specify which must be the security measures in each professional section. As put of end to this normative system we find the art. 316 and 317 of the Penal Code, that they regulate the stablishment of penal sanctions to the behaviours that it´ll break this precpets and his authorship, circunstances, etc. of hers. During this thesis, we´ll analyse content and jurisprudential interpretation of this two legals precepts, that they want to finish with those interventions that they suposse one worker´s exploration.
