Solutions or compositional processes and alternative outcomes in response to growing punitiveness

Abstract

I will start my argument by adopting the framework set by Professor Jesús Silva Sánchez in his introductory conference to the 28th International Seminar of IBCCRIM, highlighting the role of criminal dogmatics as a not only descriptive nor a functional discipline, but an evaluative and practical one that tries to provide solutions to judicial decisions in specific cases. However, I will do it by clarifying that, in this task, criminal dogmatics should not be limited to the analysis of strictly criminal regulations in a substantial sense. On the contrary, it must incorporate the national, procedural and constitutional norms, but also the conventional ones - especially Human Rights – which frame the application of these provisions to specific cases.
