The purpose of this article is to analyze the legal aspects involved in conducting clinical studies of drugs in humans, especially regarding the waiver of fundamental rights involved, based on freedom of choice and the free development of personality, which will result the promotion of scientific and technological development and the right to health in the collective perspective.
