Abstract

This article analyzes euthanasia from the perception of the Peruvian case of Ana Estrada. First, an introduction of the problems surrounding the issue is made. Then we will comment on the case of Ana Estrada and her struggle to obtain the declaration of her death with dignity. Subsequently, we will describe the right to life and the right to death. We then proceed to describe the relationship between euthanasia and the right to liberty. Later, we will identify the penal sanction that Peru establishes for euthanasia and finally, we will explain the medical protocols for practicing euthanasia. The literature review method was used, which allowed us to identify the relevant documents with the research topic. Scopus was considered as a database, which was selected because of the importance it represents in the scientific community. It was concluded that death with dignity is a right recognized by jurisprudence and that it is debatable within the framework of the protection derived in a democratic state.
