In Mexico, the autonomy of public universities is a constitutional principle which aims at safeguarding their essential liberties. This, in turn, has been guaranteed through the establishment of university courts which can solve conflicts originated within their own scope. In our view, this generates relevant questions for legal theory, especially regarding the overlap of autonomy and legal pluralism.
In this article, the method chosen is the critical reconstruction of concepts. Its results regard the identification of university courts within contemporary theories of legal pluralism. Its structure is the following: First, stock is taken of the state of the art regarding a concept of legal pluralism, considering its theoretical commitments, its conceptual history, and its analytic features. Second, the University Court of Autonomous University of Baja California, Mexico (UABC) is considered through legal pluralism, discussing the Mexican constitutional principle of the autonomy of universities along with its interface norms, incorporating general aspects of university jurisdiction, and analyzing the material scope of competences of the the University Court of UABC. The conclusion draws a concise summary and implications regarding the autonomy of universities, highlighting the increase of attributions entailed by the protection and promotion of human rights.
